2.5 Retention of data

The data is stored on Shore servers in Germany and is only used to process the booking. Users of the booking system can also rate the online demos. 6.1 Contractual relationships


beam has to process personal master data, contract data and payment details in order to create and/or maintain contractual relationships with customers. The legal basis for the processing is set out in Article 6(1)(b) GDPR.

beam processes data concerning customers and potential customers for evaluation and marketing purposes. The legal basis for the processing is set out in Article 6(1)(f) GDPR. The processing serves the legitimate interest of beam to develop its services and provide targeted information about the same.

Other processing of personal data is only effected with consent within the meaning of Article 6(1)(a) GDPR or in the course of fulfilling legal obligations within the meaning of Article 6(1)(c) GDPR.

6.2 Job applications

The website offers applicants the option of applying to beam by email. This involves the processing of personal data connected to the specific application, e.g. general data about the applicant, details on their education, qualifications and professional history and other information provided by the applicant.

beam processes personal data for the purpose of conducting the application process and to create the employment relationship, if an applicant is successful, on the basis of Article 88 GDPR in conjunction with § 26(1) and § 26(8) sentence 2 BDSG. Additionally, personal data may be processed insofar as this is necessary to fulfil legal obligations (Article 6(1)(c) GDPR) or to defend beam against legal claims. The legal basis for this is set out in Article 6(1)(f) GDPR. An example of legitimate interest in this context would be burden of proof in a process pursuant to the German General Equal Treatment Act (AGG).

Personal data is only stored for the stated purposes for as long as is necessary to fulfil this purpose. Personal data is stored for no more than 6 months for the purpose of defending beam against legal claims arising from the application process.

There is no legal or contractual requirement to provide personal data in the course of application processes. Thus, applicants are not obliged to provide information. However, personal data must be provided for beam to make a decision about an application or to conclude a contract in relation to an employment relationship. If applicants provide no personal data, beam is not able to make a decision to create an employment relationship. It is recommended that applicants only provide the personal data that is necessary in this context.

beam operates a web shop at www.shop-beam.de. Personal data is only processed in connection with the web shop insofar as this is necessary to complete the order process or insofar as users have provided this data voluntarily. Mandatory information is marked as such and only includes details required for shipping and billing, as well as contact information so that any queries can be answered. beam only uses the collected data to process the contract or for associated actions and obligations, to secure its own rights, to execute any related administrative tasks and for business organisation. Your data is blocked once the contract has been fully processed and is deleted in accordance with the provisions of tax and commercial law, unless you have explicitly consented to further data use. Your data is shared with supporting service providers for the stated purposes where appropriate. Your data is not shared with other third parties unless we are legally obliged to do this.

Cookies are created when you use the web shop, which make it easier to use this service. These cookies save your basket during the shopping process. These cookies lose their validity and function once the session is complete. The legal basis for the processing is set out in Article 6(1)(f) GDPR. 1. Organiser
The organiser of the competition is beam GmbH, Illertalstraße 3, 89281 Altenstadt, Germany (hereinafter referred to as the “Competition Organiser”).

2. Competition
The competition is not associated with Facebook or Instagram and is not being sponsored, supported or organised by Facebook or Instagram in any way.

The Competition Organiser, not Facebook or Instagram, is the recipient of the information provided by the entrant.

By entering the competition, the entrant indemnifies Facebook and Instagram against any liability.

3. Entry
The competition is free to enter. Entry is open to all natural persons aged 18 and over (age on the date of entry is decisive) who have a permanent residence in Germany, Austria or Switzerland. Entry is not open to employees of the Competition Organiser and their relatives, nor to employees of participating companies and their relatives. The Competition Organiser reserves the right to require proof of age.

An account with Facebook or Instagram is required to enter the competition. Therefore, the general terms and conditions of these platforms are a requirement and the legal basis for competition entry.

Once the winner has been identified by the Competition Organiser, the respective person will be informed about the prize via a private Facebook message. Additionally, a post may be published on the beam Facebook page, identifying the winner and using pictures or videos submitted by the winner. The Competition Organiser may also use the pictures or videos of other entrants for further posts that are directly connected to this competition. The private Facebook message will require the winner to send the Competition Organiser a private message via Facebook to confirm the prize within 14 days of receiving the prize notification. The prize lapses if the winner does not send a message by this deadline. The prize claim cannot be transferred to third parties. A new winner will not be chosen.

b. Instagram comment competitions:
the competition is entered by commenting on the competition post. For successful entry, entrants must answer the competition questions set out in the post and/or meet the other requirements. Winners are chosen at random. Insofar as only one answer proves correct, the winner is chosen at random solely from the entrants with the correct answer.

Once the winner has been identified by the Competition Organiser, the respective person will be informed about the prize via a private Instagram message. The winner will also be tagged in a story on the beam Instagram channel (instagram.com/beam_dampfsauger/) using their Instagram user name. The winner explicitly consents to this form of publication. The private Instagram message will require the winner to send the Competition Organiser a private message via Instagram to confirm the prize within 14 days of receiving the prize notification. The prize lapses if the winner does not send a message by this deadline. The prize claim cannot be transferred to third parties. A new winner will not be chosen.

c. Instagram picture competitions:
entrants enter the competition by posting a picture on their Instagram channel using the relevant competition hashtag and/or by tagging @beam_dampfsauger. Entrants must have a public profile to do this. The winner is chosen by the Competition Organiser’s jury.

Once the winner has been identified by the Competition Organiser, the respective person will be informed about the prize via a private Instagram message. The winning picture will also be published on the beam Instagram channel (instagram.com/beam_dampfsauger/) in a repost or story using the winner’s Instagram user name. The winner explicitly consents to this form of publication. The private Instagram message will require the winner to send the Competition Organiser a private message via Instagram to confirm the prize within 14 days of receiving the prize notification. The prize lapses if the winner does not send a message by this deadline. The prize claim cannot be transferred to third parties. A new winner will not be chosen.

d. Instagram story competitions:
the competition is entered by answering the competition questions asked in the story or by meeting the conditions set out in the story. Winners are chosen at random from the correct responses.

Once the winner has been identified by the Competition Organiser, the respective person will be informed about the prize via a private Instagram message. The answer and the name of the winner (Instagram user name) will also be published in a story on the beam Instagram channel (instagram.com/beam_dampfsauger/). The winner explicitly consents to this form of publication. The private Instagram message will require the winner to send the Competition Organiser a private message via Instagram to confirm the prize within 14 days of receiving the prize notification. The prize lapses if the winner does not send a message by this deadline. The prize claim cannot be transferred to third parties. A new winner will not be chosen.

7. Liability and indemnification
Insofar as entrants upload photos, the entrants guarantee that they have not sent any content that would infringe applicable law or third-party rights by being provided, published or used.

Entrants indemnify the Competition Organiser against third-party claims of any kind arising from the illegality of photos used by the entrants. This obligation also extends to indemnifying the Competition Organiser in full against the legal costs (court and legal fees) of defending these claims.

8. Choosing the winner
The winners are drawn from all entitled entrants at the end of the competition.

The prize claim lapses within two months if it is not possible to transfer a prize to a winner and the winner is responsible for this not being possible. A new winner is chosen in this instance.

Non-cash prizes are only sent free of charge within Germany with one delivery attempt. Winners must otherwise bear the transport costs and other charges (customs duties, taxes etc.). Entrants will be excluded from the prize draw if they have provided incorrect information in their competition entry or an incomplete delivery address.

The prize claim cannot be assigned or transferred. The prize cannot be supplemented or changed and there is no cash alternative. If the prize is not available, for whatever reason, the Competition Organiser reserves the right to award a replacement prize of equivalent value.

9. Premature ending of the competition
The Competition Organiser may end the competition prematurely, or suspend or alter it, if unforeseen circumstances occur over which the Competition Organiser has no influence, if it is unreasonable for the Competition Organiser to continue with the Competition under such circumstances. This includes in particular, but is not limited to, unauthorised interference from third parties, technical problems with hardware or software over which the Competition Organiser has no control, legal violations directly related to the execution of the competition, especially manipulative interference in the process of the competition or the continued commission of violations of rights concerning personality or data protection to the detriment of other entrants and/or the Competition Organiser.

10. Liability of the Competition Organiser
The Competition Organiser is only liable if and to the extent that the Competition Organiser, its legal representatives, managers, employees or other agents acts with intent or gross negligence. This does not affect other compensation claims arising from injury to life or limb, or violation of essential contractual obligations.

11. Data processing for the competition
The Competition Organiser collects and stores the following data in the course of the competition: title, name, email address, address, country. The data is only used to execute and process the competition within the framework of the legal regulations, especially to identify and inform the winners and is deleted at the end of the competition. The data is not passed to third parties. In particular, this data is not shared for advertising purposes. The data is only shared with third parties without the entrant’s consent if the Competition Organiser is legally obliged to do this. Entrants may withdraw their consent to use of personal data by the Competition Organiser at any time with effect for the future and may ask for their data to be deleted immediately. Such messages should be sent to: datenschutz@beam.de. The provisions of the Competition Organiser’s Privacy Policy also apply, which can be viewed at https://www.dampfsauger-beam.de/de/datenschutz. Entrants withdraw from the competition if they withdraw consent to data processing during the event period.

12. Severability clause
There is no legal recourse. None of the entrant’s general terms and conditions apply. The law of the Federal Republic of Germany applies. The UN Convention on the International Sale of Goods does not apply.

If individual provisions of the Competition Rules are or become invalid, this does not affect the validity of the remaining Competition Rules.
